ARTICLE 1 – PURPOSE
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by SNpâtisseries ("The Seller"), an individual business registered with the Chamber of Trades under SIREN 980 784 151, located at 11, impasse Bois d'Archat, 17500 Allas-Champagne, France, with consumers and major buyers ("The Clients"), wishing to purchase the products offered for sale by the Seller on the website www.snpatisseries.fr ("the Website").

ARTICLE 2 – ORDERS

The main features of the products are presented on the Website. The Client is required to review these before placing an order.
The choice and purchase of a product is the sole responsibility of the Client. The photographs and information displayed on the Website are not contractual and cannot, under any circumstances, hold the Seller responsible.
In the event of a discrepancy between the photographs and information, and the product(s) selected by the Client, the Seller cannot be held liable.

The Seller reserves the right to modify the composition of the products due to supply issues and/or as a precautionary measure.
Product offers are subject to available stock, as specified when the order is placed.

These General Terms and Conditions of Sale apply to the exclusion of all other conditions. They are accessible at any time on the Website and will prevail over any conflicting version or document.

Validation of the order by the Client constitutes acceptance of these General Terms and Conditions without restriction or reservation.
These General Terms and Conditions of Sale may be modified from time to time, and the applicable version for the Client’s purchase is the one in effect on the Website at the time the order is placed.

Unless proven otherwise, the data recorded in the Seller's computer system constitute proof of all transactions concluded with the Client.

SNpâtisseries reserves the right to change its prices at any time, but the product will be billed based on the price in effect at the time the order is validated, subject to availability.

Products remain the property of SNpâtisseries until full payment is received.

According to Article L.216-4 of the Consumer Code, when the Seller handles the delivery of the Product, the transfer of risks will occur when the Client physically takes possession of the Product.
Ownership of the products by the Client is transferred only upon full payment of the price. It is the recipient's responsibility to verify shipments upon arrival and make any necessary reservations if warranted.

ARTICLE 3 – PRICES
Products are provided at the prices displayed on the website www.snpatisseries.fr at the time the order is placed by the Seller. Prices are in Euros, including VAT.
These prices are fixed and non-negotiable during their validity period, as indicated on the Website. The Seller reserves the right, outside this period, to modify prices at any time. They do not include delivery charges, which are billed separately and calculated prior to order placement.

The payment requested from the Client corresponds to the total amount of the purchase, including these charges.
An invoice will be issued upon request by the Seller and provided to the Client upon receipt of the order.

ARTICLE 4 – ORDER PROCEDURES

The contractual information is presented in French and will be confirmed at the latest when the order is validated.

SNpâtisseries reserves the right not to process a payment and not to confirm an order for any reason, especially in cases of supply issues or difficulties concerning the received order.

Order Confirmation:
Any order implies acceptance of these General Terms and Conditions. Confirmation of an order entails the Client’s full and unconditional acceptance of these terms, without exception or reservation.
All provided data and the confirmed order will serve as proof of the transaction. The Client fully acknowledges this.

A summary of the order and these General Terms and Conditions will be communicated to the Client either by the email provided or in paper form, or through other digital means.

ARTICLE 5 – PAYMENT TERMS
Payments for purchases must be made in full on the day the Client receives the order, by check, Paylib, or cash. (Bank transfer is also possible to the account specified by SNpâtisseries.)
Validating the order implies the Client’s obligation to pay the specified price.

ARTICLE 6 – AVAILABILITY
Our products are offered subject to availability.
If a product is unavailable after the order is placed, SNpâtisseries will inform the Client directly by email or phone. The order will be automatically canceled, and no payment will be processed.

ARTICLE 7 – PRODUCT WARRANTY
The Seller guarantees that the products are manufactured and packaged according to strict quality standards and stored in accordance with regulations in force in France.
To assert rights, the Client must notify the Seller in writing, by email or post, of any non-compliance within three days from the delivery of the products. The Seller will replace or refund any products deemed non-compliant or defective.
Due to the perishable nature of the products, the Seller’s liability cannot be engaged if the Client fails to comply with the storage instructions or consumes products past the indicated expiration date.

ARTICLE 8 – DELIVERY
Products are delivered to the address provided during the order process.
In case of delivery delay, the Client may cancel the order according to the conditions set in Article L 138-2 of the Consumer Code.
Delivery fees are the responsibility of the Buyer, and will be mentioned and billed for each order.
The Buyer must clearly indicate if they wish to be delivered or pick up their order at SNpâtisseries' location. SNpâtisseries will arrange a delivery or pick-up appointment. SNpâtisseries is not responsible for damage to products if the provided storage conditions are not followed.

ARTICLE 9 – INTELLECTUAL PROPERTY
All elements of the SNpâtisseries website are and remain the exclusive intellectual property of SNpâtisseries. No one is authorized to reproduce, exploit, redistribute, or use any elements of the site, whether software, visual, or sound, without written permission from SNpâtisseries.

ARTICLE 10 – PERSONAL DATA
SNpâtisseries reserves the right to collect nominative information and personal data about you. These are necessary for processing your order and improving the services and information we provide.
These data are also stored for security purposes to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose your nominative information and personal data directly on the Website.

ARTICLE 11 – DATA ARCHIVING
SNpâtisseries will archive the order forms and invoices on a reliable and durable medium, constituting a faithful copy in accordance with Article 1348 of the Civil Code.
The computerized records of SNpâtisseries will be considered as proof of communications, orders, payments, and transactions between the parties.
